3. Services; No Professional Advice

Murillo’s Tile & Marble provides residential and commercial services including, but not limited to:

• Tile and stone installation
• Marble and quartz fabrication
• Countertops
• Flooring
• Showers and bathrooms
• Remodeling and related construction services
• Estimates, consultations, and project management

All information provided is for general informational purposes only and does not constitute architectural, engineering, or legal advice. We reserve the right to modify, suspend, or discontinue any part of our services at any time.

4. Accounts and Security

If you create an account or submit information through our website or forms, you are responsible for maintaining the confidentiality of your information and for all activity associated with your submissions. Notify us immediately of any unauthorized use.

5. Your Responsibilities

You agree not to:

• Violate any applicable laws or regulations
• Provide false or misleading information
• Interfere with our services or staff
• Upload harmful or malicious content
• Use automated means to access our website except as permitted

You agree to provide safe and reasonable access to the project site and ensure the area is ready for work.

6. User Content

7. Consent to Electronic Communications and E-Sign

You consent to receive communications from us electronically, including email, SMS/MMS, phone calls, and electronic records or signatures related to estimates, scheduling, invoices, or project updates. You may withdraw consent by contacting us, though certain services may not be available without electronic communication.

8. Mobile Messaging (SMS/MMS) Program

By providing your mobile number, you consent to receive text messages from Murillo’s Tile & Marble regarding:

• Estimates
• Scheduling
• Appointment reminders
• Project updates
• Invoices or customer service

9. Estimates, Project Timelines, and Deliverables

Estimates and timelines are provided in good faith based on available information.

• Estimates may change due to hidden conditions, material availability, or scope changes
• Written change orders may affect pricing and schedule
• Delays may occur due to weather, inspections, permitting, supply chain issues, or unforeseen site conditions
• Customer approval may be required before additional work proceeds

We will make reasonable efforts to communicate changes promptly.

10. Pricing, Payments, and Refunds

Pricing and payment terms will be outlined in estimates, proposals, or contracts.

You agree to:

• Pay deposits and balances as agreed
• Pay for approved change orders
• Pay invoices when due

Unless otherwise stated, payments are non-refundable once materials are ordered or work has begun. Late payments may incur fees or delay project completion.

11. Materials and Site Conditions

• Materials may vary slightly in color, texture, or finish due to natural characteristics
• Customer-supplied materials are not covered under our warranty
• Customer is responsible for clearing work areas and protecting personal property
• We are not responsible for pre-existing structural or hidden defects

12. Third-Party Services

We may work with suppliers, subcontractors, inspectors, or permitting agencies. We are not responsible for delays or actions caused by third parties beyond our control.

13. Privacy

Your use of our services is subject to our Privacy Policy. We implement reasonable safeguards to protect your information, but no system is completely secure.

14. Intellectual Property

All content on our website, including logos, text, photos, and designs, is owned by or licensed to Murillo’s Tile & Marble and protected by law. You may not copy or use it without permission.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. RESULTS MAY VARY BASED ON SITE CONDITIONS, MATERIALS, AND OTHER FACTORS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MURILLO’S TILE & MARBLE AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR PROPERTY DAMAGE.

OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

17. Indemnification

You agree to defend, indemnify, and hold harmless Murillo’s Tile & Marble from claims arising out of your misuse of our services, your property conditions, or your violation of these Terms.

18. Dispute Resolution; Arbitration; Class-Action Waiver

You and Murillo’s Tile & Marble agree to attempt informal resolution for 30 days. If unresolved, disputes will be settled by binding arbitration on an individual basis. Both parties waive the right to a jury trial or class action, except where prohibited by law.

19. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any permitted court actions will be brought in San Bernardino County, California.

20. Changes to These Terms

We may update these Terms periodically. Continued use of our services constitutes acceptance of any changes.

21. Termination

We may suspend or terminate services if these Terms are violated or for other lawful reasons. Sections that should survive termination will remain in effect.
